Referral Program Terms & Conditions

1 About the Program

The Fun Foods Direct Refer a Friend Program is a promotional rewards initiative operated by Fun Foods Direct ("we", "us" or "our").

The Program allows eligible participants ("Referrers") to share a unique referral link with other customers ("Referred Friends").

Subject to these terms:

• Referred Friends may receive a 5% discount on eligible purchases.
• Referrers may receive 5% of the qualifying referred sale value as Fun Foods Direct store credit.
• Store credit rewards are subject to a 14-day verification period.

Participation is voluntary and free.

2 Eligibility

To participate in the Program, you must:

• Be legally capable of entering into a binding agreement, or have the permission of a parent or legal guardian.
• Provide accurate information when registering or participating.
• Comply with these Terms & Conditions.
• Not engage in fraudulent, misleading or abusive referral activity.

The Program is available to eligible existing and new Fun Foods Direct customers.

A Referred Friend does not need to be a first-time customer to receive a referral discount, provided they satisfy the applicable eligibility requirements.

We may request reasonable information to verify eligibility where necessary.

3 How Referrals Work

1. A Referrer registers for the Program and receives a unique referral link.
2. The Referrer shares the link with friends, family or other eligible customers.
3. The Referred Friend accesses Fun Foods Direct using the referral link and obtains a referral discount code.
4. The Referred Friend uses the valid discount code when placing an eligible order.
5. If the order meets the Program requirements, the referral may qualify for a store credit reward.
6. Eligible store credit is issued following the applicable 14-day verification period.

Referrals must be successfully recorded by our referral tracking system. Simply sharing a link does not guarantee that a referral reward will be issued.

4 Referred Friend Discounts

Eligible Referred Friends may receive a 5% discount on qualifying purchases.

4.1 Discount Expiry

Referral discount codes expire 30 days after they are issued. Expired codes cannot be redeemed.

4.2 One Redemption Per Customer

Each customer may redeem a referral discount code once. Creating additional accounts or using different email addresses to circumvent this restriction is prohibited.

4.3 Combining Discounts

Referral discount codes cannot be combined with other product discounts, order discounts or shipping discounts.

4.4 Eligible Purchases

Referral discounts apply to eligible one-time product purchases only. Subscription purchases are excluded.

Referral discounts do not reduce shipping charges unless expressly stated otherwise.

5 Referrer Rewards

A Referrer may earn Fun Foods Direct store credit equivalent to 5% of the qualifying referred sale value.

The amount of store credit is calculated using the eligible sale value recorded by our referral system.

5.1 Reward Verification

Referral rewards are subject to a 14-day verification period following the qualifying order.

During this period, we may verify the transaction and confirm that it satisfies the Program requirements.

5.2 Reward Eligibility

A referral reward is only earned where the referred purchase satisfies the eligibility, tracking and verification requirements of the Program.

A Referrer is not entitled to a reward solely because another person has clicked their referral link.

6 Store Credit Conditions

Referral rewards are issued as Fun Foods Direct store credit.

• Store credit may be used towards eligible future purchases from Fun Foods Direct.
• Store credit is not paid as cash, bank transfer or commission.
• Store credit cannot be withdrawn or exchanged for cash.
• Store credit is associated with the eligible customer's account and is not transferable unless expressly permitted by us.
• Store credit may only be redeemed in accordance with the applicable checkout and account requirements.

Any additional conditions relating to store credit will be communicated where applicable and must comply with Australian law.

7 Qualifying Purchases

For a referred purchase to qualify for a reward:

• The referral must be recorded through the Program's tracking system.
• The order must be successfully placed and paid for.
• The transaction must not be fraudulent or unauthorised.
• The order must satisfy the applicable Program requirements.
• The order must not be cancelled, fully refunded or otherwise disqualified during verification.

No minimum purchase amount applies to the referral discount.

We may reasonably investigate suspicious transactions before approving a referral reward.

8 Prohibited Conduct

Participants must not misuse the Program.

Prohibited conduct includes:

• Referring yourself or attempting to obtain rewards from your own purchases.
• Creating duplicate or fictitious customer accounts.
• Using false names, email addresses or other misleading information.
• Using automated systems, bots or scripts to generate referrals.
• Making fraudulent purchases or arranging transactions solely to obtain rewards.
• Circumventing the one-use-per-customer discount restriction.
• Sending unsolicited commercial messages in breach of applicable spam or privacy laws.
• Misrepresenting your relationship with Fun Foods Direct.

8.1 Fraud Prevention

Our referral system may use technical checks, including browser and IP address information, to identify potential self-referrals or abuse.

Referrals originating from the same browser or IP address may be blocked or flagged for review.

We may investigate suspected misuse and withhold or reverse rewards where there is a reasonable basis to conclude that these terms have been breached.

9 Returns, Refunds & Cancellations

If a referred order is cancelled, refunded, reversed or determined to be fraudulent, the associated referral reward may be cancelled or adjusted.

Where a partial refund occurs, the referral reward may be recalculated to reflect the remaining qualifying sale value.

If store credit has already been issued for a transaction that is later reversed, we may make a reasonable adjustment to the associated promotional reward balance, subject to applicable law.

Nothing in this section limits a customer's statutory refund or consumer guarantee rights.

10 Program Changes & Termination

Fun Foods Direct may modify, suspend or discontinue the Program from time to time.

Changes may include adjustments to referral eligibility, reward rates, discount values, verification requirements or other Program features.

Where reasonably practicable, material changes will be communicated through our website or other appropriate channels.

Changes will generally apply prospectively. Rewards already validly earned will be handled in accordance with the terms applicable when they were earned, subject to applicable law.

We may suspend or terminate participation where a participant breaches these terms or engages in fraudulent or abusive activity.

11 Technical Issues & Tracking

The Program relies on third-party software and technical systems to track referrals and calculate rewards.

Tracking may be affected by:

• Browser privacy settings.
• Disabled cookies.
• Ad-blocking software.
• Incorrect referral links.
• Technical interruptions.
• Other tracking limitations.

Where a referral is not automatically recorded, participants may contact us with relevant order details so we can investigate the matter.

We will assess genuine tracking disputes reasonably, having regard to the available evidence.

12 Privacy & Personal Information

Personal information collected through the Program may be used to:

• Administer referral accounts and rewards.
• Verify qualifying purchases.
• Detect and prevent fraudulent referral activity.
• Communicate relevant Program information.
• Comply with applicable legal obligations.

Information may be processed by service providers that assist with the operation of the Program, subject to applicable privacy laws.

Promotional marketing communications will be sent only where permitted by applicable law and relevant consent requirements.

13 Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

Where a customer is entitled to a refund or other remedy under applicable law, these rights remain unaffected by participation in the Program.

14 General Conditions

14.1 Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia, subject to any mandatory laws that apply.

14.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

14.3 Program Administration

Fun Foods Direct may make reasonable administrative decisions relating to referral eligibility, tracking and rewards, subject to these terms and applicable law.

14.4 Separate Affiliate Program

The Refer a Friend Program is separate from the Fun Foods Direct Affiliate Program.

Referral rewards are provided as store credit, whereas approved affiliates may earn commission under separate Affiliate Program terms.
